Western IA man to be sentenced on drug charges next month

A western Iowa man will be sentenced to a possible 10-years in prison next month, on drug charges. The Audubon County Sheriff’s Office reports that on Tuesday, January 29th, 2019 a jury trial was held for 38-year old Ian Lee Leib, on charges that include felony Possession of a Controlled Substance/Methamphetamine, with the Intent to Deliver. The charge had a lesser-included offense, Possession of a Controlled Substance, which the jury had the option of convicting Leib of, if they did not believe the State had proved the “intent to deliver” element of the crime charged. Leib is from the Kimballton and Council Bluffs areas.

Authorities say the State’s witnesses included Audubon County K9 Deputy Nathan Tibbets, Shelby County Deputy Chad Butler, and expert witness Special Agent Bob Jones of the Division of Narcotics Enforcement. Leib did not take the stand. After about 15 minutes of deliberation, the jury convicted Leib of the crime as charged by the State, finding him guilty of Possession of Methamphetamine with the Intent to Deliver. That verdict means the jury rejected the option of the less serious, lesser-included offense of simple possession as well as the not guilty option.

Leib will be sentenced in Audubon on March 7th at 9:30 AM.  The Audubon County Sheriff’s Department says that while the code allows for the maximum 10-year sentence to be suspended, the State will use Leib’s lengthy criminal history to support its strong recommendation that he be sent to prison. If Leib is sent to prison, he would face a mandatory minimum of one-third of 10 years, or about three-years and three-month. After the trial, Leib was transported to the Pottawattamie County jail to resolve a pending probation violation in that county. He will likely be held there until sentencing on the Class C felony in Audubon County in March.

Atlantic Police report 5 arrests

Five people were arrested in Atlantic over the past couple of weeks. The Atlantic Police Department reports 45-year old Eric Haley, of Atlantic, was arrested Sunday on a Cass County warrant for Indecent Contact with a Child. On Saturday, 29-year old Joseph White, of Atlantic, was arrested for Domestic Abuse Assault/2nd offense, and Obstruction of Emergency Communications. Last Thursday, 33-year old Casey Schulte, of Atlantic, was arrested for Impersonating a Public Official, and on a Cass County warrant for Probation Violation.

On Feb. 3rd, 31-year old Aaron Ihnken, of Atlantic, was arrested on a Cass County warrant for Theft in the 5th Degree. And, on Feb. 2nd, 47-year old Amy Rollins, of Atlantic, was arrested for Theft in the 5th Degree (Shoplifting). Rollins was cited into court and released. Each of the other subjects were booked-into the Cass County Jail.

Fatal crash in Union County Sunday afternoon

One person died and two people were injured during a collision Sunday afternoon, in Union County. The Iowa State Patrol reports a 1998 Dodge pickup driven by 21-year old Emily M. Haidsiak, of Creston, was traveling west on Highway 34 at around 12:17-p.m., when she lost control of the vehicle on the snow and slush covered road. The pickup crossed the center line west of Creston and entered the eastbound lane, where it struck an eastbound 2017 Chrysler minivan. The driver of the van – who was not wearing a seat belt – died at the scene. Their name was withheld pending notification of family. Haidsiak, and an infant passenger in her vehicle – who were properly belted-in – were transported by ambulance to the Greater Regional Medical Center, in Creston, for treatment of non-life threatening injuries.

The accident remains under investigation. The Iowa State Patrol says they responded to 30 crashes from 5 a.m. Sunday morning until noon, across Iowa.

Creston Police report (2 arrests)

Officials with the Creston Police Department report two separate, recent arrests. On Sunday, 29-year old Chad Sterling Cozad, of Creston, was arrested for Possession of a Controlled Substance/3rd offense, and Possession of Drug Paraphernalia. His bond at the Union County Jail was set at $5,300. And, Friday afternoon, 30-year old Cherrie Lee Palmer, of Afton, was arrested in Creston for Theft in the 3rd degree. Palmer was being held for Union County in the Adams County Jail, where her bond was set at $2,000.

$2M Powerball prize ticket bought in Burlington

BURLINGTON, Iowa (AP) — Someone bought a Powerball ticket in Burlington worth $2 million. Iowa Lottery officials say the ticket matched the first five numbers in Saturday’s drawing but missed the Powerball number. The match of five numbers is worth $1 million, but the person also added the Power Play option, multiplying the prize to $2 million. No one matched all six numbers to win the $223.6 million jackpot. Saturday’s winning numbers were 1, 2, 3, 7, 39 and Powerball 25. The ticket was bought at the Hy-Vee store at 3140 Agency St. in Burlington.

Villisca man arrested Sunday night

Deputies with the Montgomery County Sheriff’s Office, Sunday night, arrested 20-year old Wyatt Dean Baldwin, of Villisca. He was taken into custody at around 9:30-p.m. in Villisca, for Driving While Suspended. Baldwin was transported to the Montgomery County Jail and held on bond amounting to slightly more than $566. He was also cited for Failure to Prove Security Against Financial Liability (proof of Insurance).

OMAHA, Neb. (AP) — Officials say the reservoirs along the Missouri River are ready to handle the floodwaters that are expected to flow into the system this year. The U.S. Army Corps of Engineers says it has the full flood storage space available in the reservoirs, so it is in good shape headed into the year.

CEDAR RAPIDS, Iowa (AP) — Democrat Elizabeth Warren is taking aim at President Donald Trump, saying he “may not even be a free person” by next year’s election. The Massachusetts senator has largely avoided talking about Trump since she began testing the waters for a campaign more than a month ago. She’s been a frequent target of the president, who has criticized her past claims to Native American heritage, including in a tweet Saturday night.

ELDORA, Iowa (AP) — Video taken on the cellphone of a woman accused of abusing her boyfriend’s young son shows the boy screaming in agony that he needed to use the bathroom before he eventually wets himself. The Courier reports that prosecutors showed the cellphone video of the 8-year-old boy Friday during the kidnapping trial of 40-year-old Traci Tyler. Tyler and her boyfriend, 30-year-old Alex Shadlow, are each charged with kidnapping in the abuse case.

ASBURY, Iowa (AP) — Hundreds of water-soaked library books in eastern Iowa are in a deep-freeze while officials figure out how to save the publications. The Telegraph-Herald reports the books were damaged Feb. 1 when a pipe burst in the Dubuque County Library’s branch in Asbury. When books get wet, they must be frozen within hours to prevent the growth of mold. The books were first moved to a refrigerated semi-trailer provided by Hy-Vee and then carried to another trailer provided by Hirschbach Motor Lines.

Prisoners of War the subject of a presentation Feb. 17th in Atlantic

Enemy soldiers invaded Iowa, legally, during World War II. German, Italian and Japanese prisoners held in 2 major and 30 branch camps worked on farms and in agricultural related businesses. A program, “Working with the Enemy”, will be presented 2-p.m. Sunday, February 17th, at the American Legion Memorial Building, in Atlantic. Chad Timm, Professor at Simpson College, heard stories from his grandmother who told him about Japanese men who worked at Earl May in 1945. Their conversation sparked an interest to find out more.

Atlantic Rock Island Society Enterprise (ARISE) sponsors the program. Funds have been received from Humanities Iowa, a private, non-profit state affiliate of the National Endowment for Humanities. Humanities Iowa offers many cultural and historical programs and grants to Iowa’s communities, There is no fee to attend. Everyone is welcome. The meeting space is handicapped accessible. Refreshments will be offered.

The Military Museum, Military Library and Atlantic History Center will be open for viewing.
