Jacobsen wins House District 22 seat in western IA

Unofficial results from the Pottawattamie County Auditor’s Office late Tuesday night, indicated Republican Jon Jacobsen had won a Special Election for Iowa House District 22, to fill a vacancy created in May, by the death of Representative Greg Forristall. Jacobsen currently serves as the Senior Trust Officer and Vice President of a bank in Council Bluffs.

According to the Auditor’s Office, Jacobsen garnered nearly 44-percent of the vote (1,069) votes. Carol Forristall, the widow of the late Greg Forristall, who was running as an Independent, received nearly one-third of the votes (803). Democrat Ray Stevens, who ran as a write-in candidate, received just over 19-percent of the votes (465). And, Libertarian candidate Bryan Holder received 98 votes or slightly more than four-percent.

Voter turnout was a little more than 9.5-percent, with 2,441 voters being cast out of 23,723 registered voters in the 16 precincts. Six were blank.

DES MOINES, Iowa (AP) — A father and son whose Iowa-based egg production company caused a massive 2010 salmonella outbreak have exhausted their appeals and a federal judge has ordered them to begin serving prison sentences. Peter DeCoster, 53, must report to the Federal Prison Camp in Yankton, South Dakota after July 30 and his 83-year-old father Austin “Jack” DeCoster must serve his three-month term at the Federal Correctional Institution in Berlin, New Hampshire, 30 days after Peter is released.

VERSAILLES, Mo. (AP) — A Missouri state trooper accused in the death of an Iowa man who drowned in lake while handcuffed will avoid a manslaughter trial after pleading guilty to a misdemeanor boating violation. The Kansas City Star reports Trooper Anthony Piercy entered the plea Tuesday. Investigators say Piercy stopped 20-year-old Brandon Ellingson at the Lake of the Ozarks in 2014. Ellingson was in the patrol boat with Piercy when he fell into the lake while handcuffed and wearing an improperly secured life vest.

DAVENPORT, Iowa (AP) — A Davenport elementary school teacher has been charged with possession and receipt of child pornography. The Quad-City Times reports that a federal complaint against 43-year-old Michael Loren Ross was unsealed Monday, when he made his first court appearance in Davenport. Prosecutors say Ross told officers who searched his home last week that he had child pornography and that he had both received and distributed it.

AMES, Iowa (AP) — Police say 20 animals were seized from the home of an Ames woman accused of trying to perform surgery a puppy in her living room, which resulted in the dog’s death. The Des Moines Register reports that following a search Friday of 26-year-old McMenanim’s home, officials seized three dogs, two cats, six guinea pigs, five rabbits, two salamanders and two geckos. Officials say the animals’ cages and aquariums were covered in feces and urine.

Griswold School Bond Measure passes!

Voters in the Griswold Community School District have approved a $9.9-million dollar General Obligation Bond issuance for the district’s facilities. The unofficial total from the Cass County Auditor’s Office, show 62.46% of the voters said YES (589), while 37.540% said NO (354). The results of the vote will be canvassed during a meeting of the Cass County Board of Supervisors.

The $9.9-million dollar bond issue would help to pay for a new, 33-thousand square foot elementary building onto the south side of the Griswold Middle School/High School campus. The district’s other buildings and students would be consolidated into the one campus location at Griswold.

Breakdown of the polling site results as follows:

Absentee – YES 68, NO 26

Elliott Community Bldg. – YES 93, NO 87

Griswold Community Bldg. – YES 347, NO 105

Lewis Library – YES 81, NO 136

Total votes cast: 943.

Red Oak School Bond Measure passes by super majority of the vote

Voters in the Red Oak Community School District have overwhelmingly approved a $19.9-million bond measure that will reduce the number of district buildings by one, and allow for the renovation of the districts three remaining buildings. The ballots cast were 987 YES (76.69%) and 300 NO (23.31%). A 60-percent super majority of votes was needed in order for the measure it to pass. The results are unofficial until canvassed by the Montgomery County Board of Supervisors. Voter turnout Tuesday was 27.55%, or just 1,287 out of a possible 4,672 registered voters.

With voter approval, the District’s pre-K and kindergarten students will be served at  the Washington Elementary School in Red Oak. The 1st through 6th graders at the Inman Primary School, and 7th through 12th grade students at the Red Oak High School. The move is designed to save the District about $400,000 per year. The total project cost is estimated at $29.16-million, with the State penny sales tax making up the difference between the $19.9 and 29.16-million.

The district tax levy will become $15.60 per $1,000 of taxable property value. The current levy is $14.28, while the levy approved for fiscal year 2017-2018 is $14.49, according to the district.

Harlan Police report (6/27)

The Harlan Police Department issued a report on arrests and accidents, Tuesday afternoon. Authorities say 28-year old Charles Alexander Watts, and 24-year old Kara Mahrt, both of Harlan, were transported to the Shelby County Jail Monday, following a call in reference to a possible domestic situation in the 1700 block of 8th Street. Watts was charged with public intoxication, and Mahrt was charged with domestic abuse assault.

Last Sunday, 39-year old Marty Joe West, of Harlan, was arrested following a traffic stop. West was brought to the Shelby County Jail and charged with OWI/2nd offense. He was also cited for dark windows and an improper rear tail lamp.

And, on Saturday, 31-year old Kaila Fate, of Harlan, was cited for Driving While Suspended, following a traffic stop.

Harlan Police also investigated a few recent accidents, including one that happened June 2oth, when Marjorie Thomsen, of Tennant, struck a building in the 1100 block of Morningview Drive. Thomsen had intended to step on the brake, but hit the gas pedal instead. A dollars amount of the damage was not listed in the police report.

Audubon County road to be closed for bridge replacement

The Audubon County Engineer’s Office, Tuesday, said the 2100 block of Lark Avenue between 215th and 220th Streets in Leroy Township section 36, will be closed for a bridge replacement project, beginning July 11th and continuing for about 65 working days. Completion is expected by mid-October, weather permitting.

Addresses at 2167 and 2188 Lark Avenue will only be accessible from the south. Residents and emergency responders will need to plan alternate routes to reach residences in the area, when the bridge replacement project begins. Red Oak man arrested for Parole Violation Tuesday

The Montgomery County Sheriff’s Office reports the arrest Tuesday of 37-year-old Kenneth W. Dine of Red Oak on a felony warrant for Parole Violation. Dine was arrested at 3:15pm at the Montgomery County Law Enforcement Center. The parole was in place for the original charge of 3rd Degree Sex Abuse. Dine was held without bond in the Montgomery County Law Enforcement Center.

I-80/I-480/U.S. 75 interchange – westbound I-80 and northbound U.S. 75 ramp closures

The Iowa Department of Transportation, as a courtesy to the Nebraska Department of Roads, is advising motorists of impending extended closures of the westbound Interstate 80 ramp to northbound I-480, northbound U.S. 75 ramps to westbound I-80 and northbound I-480, and the F Street entrance ramp to northbound U.S. 75. The closures are scheduled to take place 10-p.m. Wednesday, July 5th, according to the Nebraska Department of Roads.

These extended ramp closures are necessary for bridge deck repairs. The project is anticipated to be completed by fall 2017. (See map below for suggested detour route – eastbound I-80 to northbound I-29 to westbound I-480.)

Cramer and Associates Inc., of Grimes, Iowa, is the contractor on this project. Motorists are urged to drive cautiously through construction zones, along detours and selected alternate routes.

Missouri trooper pleads in handcuffed drowning of Iowa man

VERSAILLES, Mo. (AP) — A state trooper charged with involuntary manslaughter after an Iowa man drowned after falling from a patrol boat into a Missouri lake has pleaded guilty to a misdemeanor boating violation. The Kansas City Star reports Trooper Anthony Piercy pleaded guilty Tuesday to negligent operation of a vessel in the May 2014 death of 20-year-old Brandon Ellingson, of Clive, Iowa. Piercy was scheduled for trial July 10 in Morgan County.

Piercy had stopped Ellingson at the Lake of the Ozarks on suspicion of boating while intoxicated. While riding in a boat driven by Piercy, Ellingson fell into the lake while wearing handcuffs and an improperly secured life vest. Piercy jumped into the lake but couldn’t save him.

The state of Missouri last year paid $9 million to Ellingson’s family.

Bluffs man found guilty in connection w/2016 Cass County pursuit and assault on Deputy

A man from Pottawattamie County was found guilty Monday in Cass County District Court, on charges resulting from a pursuit that occurred nearly one-year ago. Judge Jeffrey L. Larson found 38-year old Joseph Lee Ray Bartlett, of Council Bluffs, guilty on five counts: Two counts of assault on persons in certain occupations; two counts of criminal mischief in the 2nd degree, and one count of eluding. His sentencing date has not yet been set. Bartlett, who had earlier waived his rights to a jury trial, remains in the Cass County Jail, where has been held since January 10th.

Bartlett was the subject of a July 3rd 2016 pursuit that went through Pottawattamie County and into Griswold on Highway 92. The SUV he was driving was traveling at speeds of up to 90-miles per hour through Griswold and continued east to Highway 71, where Cass County Deputy Ben Bartholomew was waiting with “stop sticks” deployed. The SUV hit the sticks at around 1:30-a.m. and entered a field, came back out of a ditch and rammed into the rear of Bartholomew’s cruiser.

The SUV continued into the intersection at Lyman, where Pott. County Deputies performed a PIT maneuver on the vehicle. The vehicle continued and eventually struck Deputy Bartholomew’s cruiser on the front and nearly struck Deputy Kyle Quist’s SUV. The suspect continued to drive south on Highway 71 for a couple of miles before the vehicle became disabled. No injuries were reported.

Bartlett was taken into custody and transported to the Pottawattamie County Jail, where he’s charged with Eluding with Injury and OWI/1st offense. His jury trial there is set to begin July 25th. Bartlet plead guilty earlier this year in Montgomery County to charges of Burglary in the 3rd degree, and Theft in the 2nd degree. He was given a five-year suspended prison sentence, with credit for time served, plus two-years probation.
