OMAHA, Neb. (AP) — The Nebraska Court of Appeals has reinstated the revocation of a man’s driver’s license after a lower court found the state Department of Motor Vehicles had wrongly revoked it. Joshua Stone, now of Crescent, Iowa, was arrested on suspicion of drunken driving in February 2011 and his license revoked for one year. Stone appealed, and a Sarpy County judge reversed the revocation, based on a department hearing officer’s sworn report saying there was enough evidence to revoke Stone’s license. But the report had been signed a day before the hearing, leading the judge to believe that the officer had decided the matter before hearing evidence in the case. The department appealed, and the Nebraska Appeals Court found Tuesday that the lower court did not have jurisdiction in the case.
