(Radio Iowa) – The Iowa Attorney General’s office says the fatal shooting of a Johnston man by Polk County deputies was justified. Polk County Deputies were working with Johnston police in trying to take Austin Mark into custody on a felony warrant and a mental health pick-up order on June 1st. Deputies say Mark barricaded himself inside his garage and refused to surrender.
Deputies raised the garage door slightly to deploy pepper balls, but Mark raised it all the way and began shooting. One deputy was hit in the hand and required surgery, while shots hit the ballistic shield of another deputy. Mark then started items in the garage on fire and walked out and was shot. He fell down and died and a gun was found where he fell.
